Poker Stars – What have we done wrong?

Posted:July 2012

It is without a doubt that PokerStars is the jewel in the crown of todays’ online poker industry, despite one or two minor setbacks. Regardless of the fact that this company continued to offer services to online poker players in the USA after the promulgation of UIGEA in 2006, they constantly maintained an above-board profile. The site was and still is ultimately professional, is represented by some of the best professionals in the land-poker biz, but was still closed down by the DoJ on the 15th April last year (2011). This day became known as Black Friday in poker circles.

After the advent of this tragic date for Full Tilt, Ultimate Bet and Absolute Poker who were not able to stand their ground – PokerStars has gone from strength to strength, but are still left with civil suits to deal with and a number of serious allegations against them. According to the Department of Justice (DOJ) at that time, online poker was illegal, even though now they have changed their opinion. However, the charges brought against PokerStars were not only for offering this game online. There were all kinds of nasty civil charges laid against the company and its subsidiaries.

Civil complaints have been amended to invoke "shady dealings and/or far-reaching conspiracies", and understandably a company the size of PokerStars, with their reputation to uphold, does not want to have truck with wishy-washy DoJ complaints. Their lawyers maintained they were not acting illegally by offering online poker to US players, and this was why they continued to do so, so, now PokerStars wants to know why the DoJ fails to satisfy legally viable theories. In other words the DoJ has been vague with regards to charges, and these appear to be trumped-up.

The brand is standing their ground and not giving in to legal pressure. Unfortunately the same cannot be said for FTP and other brands, whose principals appear to be caving in one-by-one. PokerStars wants to know what they have done wrong in order to marshal a strong defense.
